These Terms and Conditions ("Terms") govern your use of caesarmails.com (the "Website") and set the general framework for working with CaesarMails, based in Lithuania ("CaesarMails", "I", "me"). By using the Website or booking a call, you agree to these Terms.
The services
CaesarMails provides email and SMS marketing services for eCommerce brands, including strategy, flow and campaign creation, pop-up and list growth setup, account management, and related consulting. The exact scope, deliverables, timeline, and fees for any engagement are agreed individually before work starts, in a separate proposal or agreement. These Terms apply alongside any such agreement; where they conflict, the individual agreement wins.
No guarantee of results (disclaimer)
CaesarMails does not guarantee your financial results. Every brand is different and outcomes depend on factors unique to your business, including your list size, offer, market, and how we work together. The results shown on the Website are real and from actual brands worked with personally. They are not typical and should not be taken as a promise of earnings. What is typical is that brands who show up, commit to the process and trust the strategy see their email channel grow. Those who do not, do not. Every business carries risk. Results require effort, consistency, and time. This is not a guarantee. It is a commitment to work harder on email marketing than anyone else has.
Free audits and calls
Booking a free audit or call creates no obligation on either side. I review the information you share to give you an honest assessment. If I do not believe I can help you, I will tell you, and neither of us owes the other anything.
Your responsibilities
- Provide accurate information about your brand and the access needed to deliver the agreed work.
- Make sure the customer data and lists you give me access to were collected lawfully and that you have the right to use them for marketing.
- Review and approve materials before they go live where approval is part of the agreed process.
Fees and payment
Pricing depends on your brand size, goals, and scope, and is agreed individually before an engagement starts. Unless agreed otherwise in writing, invoices are payable within the term stated on the invoice, and work may be paused if payment is overdue.
Intellectual property
All content on the Website, including copy, design, and graphics, belongs to CaesarMails and may not be copied or reused without permission. Client screenshots and results are shown with the underlying data anonymised. Materials created for you as part of a paid engagement belong to you once they are paid for; your brand assets always remain yours.
Confidentiality
Information you share about your business for the purpose of an audit or engagement is treated as confidential and is not shared with third parties except as needed to deliver the services or where the law requires it.
Third party services
The Website embeds third party services such as the call booking widget. Engagements typically involve third party email, SMS, and eCommerce platforms. Your use of those platforms is governed by their own terms, and I am not responsible for their availability or actions.
Limitation of liability
To the maximum extent permitted by law, CaesarMails is not liable for indirect or consequential losses, including lost profits or lost revenue, arising from the use of the Website or the services. For paid engagements, total liability is limited to the fees you paid for the services in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
Termination
Either side may end an engagement as set out in the individual agreement. Work completed up to the end date remains payable.
Governing law
These Terms are governed by the laws of the Republic of Lithuania. Any dispute that cannot be resolved amicably will be settled by the competent courts of Lithuania. If you are a consumer in the EU, mandatory consumer protections of your country of residence remain unaffected.
Changes to these Terms
I may update these Terms from time to time. The current version will always be available on this page with the date of the last update at the top.
